The main document regulating the amount of the state fee / court fee in Ukraine is the Decree of the Cabinet of Ministers of Ukraine dated January 21, 1993 No. 7-93 “On the state fee” and Law of Ukraine” On court fee “[/ mask_link].   • through the registry office;
  • judicially.

In order to break a family union through the state registration of acts of civil status (Civil Registry Office), the spouses must meet a number of mandatory conditions:

  1. The desire to end a marriage should be general (except for cases specified by law).
  2. The couple does not have common minor children.

A receipt for payment of the state duty with the necessary details is issued by the specialists of the registry office for payment at the nearest bank branch directly on the day of filing the application for divorce. A receipt for payment of this public service is a mandatory attachment to the application, and without it, a divorce certificate cannot be issued. Also, today in most departments of the registry office in Ukraine there are already terminals for making payments for services directly on the spot.

In exceptional cases, the law does not prohibit unilateral divorce due to the registry office – when it is impossible to obtain the consent of the other spouse, because he:

Also, it is worth paying attention to the fact that if the plaintiff, when filing a statement of claim, incorrectly determined and paid the amount of the court fee, the court will make a decision and independently indicate the required amount of the court fee to be paid.

If, when filing a statement of claim, the plaintiff does not have the entire amount to pay the court fee, it is possible to ask for a deferral (installment plan) of its payment, or the court may decide to reduce its amount due to the documented difficult financial situation of the plaintiff.
