How to file a divorce in Ukraine?
According to the norms of the Family Code of Ukraine and the Rules for the registration of acts of civil status in Ukraine, there are two ways to file a divorce: in the bodies of the GRATSS (state registration of acts of civil status) and in court. - spouses agree to divorce and they do not have common children under 18 years old – in this case, the husband and wife submit a joint application;
- one of the spouses: recognized by the court as missing or incompetent.
In the second case, the application is terminated unilaterally, regardless of whether the couple has minor children. At the same time, in case of incapacity of one of the spouses, his guardian has the right to apply to the DRAC with a statement.
Spouses who do not have minor children can also divorce through the DRACS by mutual consent if there is a dispute between them about the division of common property or about cash payments (alimony) for the maintenance of a disabled spouse. Such disputes are considered separately in court, regardless of the registration of divorce.
According to the Family Code of Ukraine, you will have to get divorced through the court if:
- a married couple has minor children (except in cases of absence of a missing person or recognition of a person as incapacitated or serving a sentence for committing a crime by one of the spouses indicated above);
- one of the spouses does not agree to a divorce;
- husband and wife are not averse to divorce, but one of them evades divorce at the registry office, including refusing to file an application.

If one of the spouses cannot appear in person (for example, he went on a business trip), then separate applications can be submitted. In this case, the signature of the person must be certified by a notary.
If the marriage is dissolved through the registry office at the request of one of the spouses (the second is missing or incompetent), an application is submitted and a state duty is also paid.
To apply for divorce to the DRATSS authority, the following documents will be required:
- passports;
- Marriage certificate;
- a court document adopted in respect of an incompetent or missing person (if the application is submitted unilaterally);
- receipt for payment of state duty.
After a month from the date of filing the application, the employees of the DRACS bodies register the dissolution of the marriage and make an appropriate entry in the civil status register, while at least one of the spouses must be present. From that day on, the marriage is terminated – the spouses can take the certificate of divorce. Obtaining this document is voluntary.
