Hello! In this article, I will tell you about how to file a divorce through the registry office or through the court, as well as how to file a divorce online.

How to file a divorce in Ukraine?

According to the norms of the Family Code of Ukraine and the Rules for the registration of acts of civil status in Ukraine, there are two ways to file a divorce: in the bodies of the GRATSS (state registration of acts of civil status) and in court. However, in order to speed up and simplify the filing of a divorce through the DRACS authorities (no waiting in lines, not spending a lot of time on the road), there are alternative ways to apply for a divorce:

  • state free lawyer – this requires the personal presence of the husband and wife;
  • online divorce – to part with a man in this way, you need to submit documents in electronic form via the Internet.

It should be borne in mind that state lawyers do not in themselves dissolve the marriage, but are only intermediaries between the spouses and the civil registration authority. A certificate of divorce from a court decision is not issued.

The option to get a divorce through the DRACS (that is, administratively) takes less time and is easier than through the courts, however, the following conditions are provided for this:

  1. spouses agree to divorce and they do not have common children under 18 years old – in this case, the husband and wife submit a joint application;
  2. one of the spouses: recognized by the court as missing or incompetent.

In the second case, the application is terminated unilaterally, regardless of whether the couple has minor children. At the same time, in case of incapacity of one of the spouses, his guardian has the right to apply to the DRAC with a statement.

Spouses who do not have minor children can also divorce through the DRACS by mutual consent if there is a dispute between them about the division of common property or about cash payments (alimony) for the maintenance of a disabled spouse. Such disputes are considered separately in court, regardless of the registration of divorce.

According to the Family Code of Ukraine, you will have to get divorced through the court if:

  • a married couple has minor children (except in cases of absence of a missing person or recognition of a person as incapacitated or serving a sentence for committing a crime by one of the spouses indicated above);
  • one of the spouses does not agree to a divorce;
  • husband and wife are not averse to divorce, but one of them evades divorce at the registry office, including refusing to file an application.

How to get a divorce through the registry office in Ukraine

As noted above, a divorce through the DRACS can be by mutual agreement or at the request of one of the spouses.

In order to personally submit a joint application and voluntarily divorce through the DRACS authorities, spouses who do not have minor children must appear at the DRACS authority at the place where the marriage was registered, or at the place of residence of one of the spouses. For registration of dissolution of marriage by mutual consent of spouses who do not have minor children, and the issuance of a certificate, it will be necessary to pay a state duty. A receipt with payment details will be issued at the DRACS department when applying.

If one of the spouses cannot appear in person (for example, he went on a business trip), then separate applications can be submitted. In this case, the signature of the person must be certified by a notary.

If the marriage is dissolved through the registry office at the request of one of the spouses (the second is missing or incompetent), an application is submitted and a state duty is also paid.

To apply for divorce to the DRATSS authority, the following documents will be required:

  • passports;
  • Marriage certificate;
  • a court document adopted in respect of an incompetent or missing person (if the application is submitted unilaterally);
  • receipt for payment of state duty.

After a month from the date of filing the application, the employees of the DRACS bodies register the dissolution of the marriage and make an appropriate entry in the civil status register, while at least one of the spouses must be present. From that day on, the marriage is terminated – the spouses can take the certificate of divorce. Obtaining this document is voluntary.

How to file for divorce ONLINE in Ukraine

Multifunctional centers are designed to simplify and speed up the process of interaction between individuals and legal entities with authorities. The procedure and conditions for filing an application for divorce through the web portal the same as when submitting directly to the DRACS authority. The difference is only in the place of initial submission of documents.

How to file a divorce online (Internet) in Ukraine

The law of Ukraine also provides for the possibility to send an application for divorce to the GRATSS body in the form of an electronic document through the web portal “Appeal in the field of state registration of acts of civil status”.

In case of mutual agreement to part with the husband and wife, it is necessary:

  • fill out a double application form;
  • attach the required documents;
  • pay the state duty (each person pays for himself).

Also, online, you can apply for registration of divorce on the basis of a court decision on recognizing the second spouse as missing or incapacitated.

If there is a property dispute between the spouses, then apply for a divorce through the web portal. However, this dispute will be resolved in court.
